UNAM and Anáhuac host the presentation of the book ‘The Creative Power of Constitutional Courts’ presented by Carlos Bardavío
Written by Super UserCarlos Bardavío presented El poder creador de los tribunales constitucionales (The Creative Power of Constitutional Courts) (Aranzadi, 2024) at the National Autonomous University of Mexico (UNAM) and the Anáhuac University of Mexico. At both institutions, Bardavío shared with academics and students his analysis of the role of constitutional courts in shaping and evolving the legal system, emphasising the importance of constitutional interpretation in consolidating the rule of law.
His participation helped to strengthen international academic exchange and enrich the debate on new perspectives in constitutional law.

La jurisprudencia española avala los fundamentos del Dr. Bardavío sobre el delito de persuasión coercitiva

La jurisprudencia española ha acogido las consideraciones publicadas de la tesis doctoral del Dr. Carlos Bardavío sobre el delito de persuasión coercitiva. La Sentencia de la Audiencia provincial de Pontevedra en el famoso caso de los "Miguelianos" (Orden religiosa acusada de secta coercitiva) le cita como autor de referencia (entre otros como José Miguel Cuevas Barranquero) y acoge su fundamentación de que la persuasión coercitiva es una modalidad violenta que limita o anula la capacidad de libre voluntad de actuar en general (restricción del horizonte de expectativas legítimas) que pertenece básicamente al tipo de coacciones agravado, lo que también refuerza su conclusión de que dada la baja penalidad de este delito (3 años de prisión) resulta necesario una tipificación adaptada a la alta gravedad de la acción y del resultado.
